The Digital Services Act (DSA) within the European Union came into force on the 17th of February 2024 and seeks to establish a unified and seamless framework of regulations for digital service providers operating across all 27 member states of the EU.
Under the DSA, very large online platforms, online platforms, hosting services and intermediary services are obligated to institute both ad-hoc and continuous Trust & Safety mechanisms tailored to the active user-base within the EU. Micro and small companies will have will have obligations proportionate to their ability and size while ensuring they remain accountable.
Impact
Non-compliance with these requirements exposes companies to significant fines, amounting to as much as 6% of their annual turnover. Additionally, in cases of repeated violations, companies face the possibility of being banned from operating within the entire EU.
