Since February 2022, Germany’s Network Enforcement Act (NetzDG) mandates that social media platforms boasting over 2 million users must swiftly remove “clearly illegal” content within 24 hours of posting, and all illegal content within 7 days.
Impact
Failure to do so could result in fines of up to 50 million Euros. Additionally, platforms are required to delete and report content infringing criminal laws. Deleted content must be retained for a minimum of 10 weeks, and platforms must issue transparency reports every six months detailing their efforts to address illegal content.
